Agreement to Terms

Welcome to Rescue Tracker. By accessing or using our animal rescue management platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users, including rescue organizations, volunteers, foster families, donors, and individual pet owners.

Definitions

• "Service" refers to the Rescue Tracker platform and all associated features
• "User" refers to anyone who accesses or uses the Service
• "Rescue Organization" refers to paid subscribers using the platform for animal rescue management
• "Pet Owner" refers to individual users with free accounts for personal pet record management
• "Content" refers to all data, text, images, and information uploaded to the Service

User Accounts

Account Types

Rescue Organization Accounts (Paid):

• Require a paid subscription
• Provide full access to rescue management features
• Allow multiple user access within the organization
• Include dedicated support

Pet Owner Accounts (Free):

• Completely free for individual pet owners
• Limited to personal pet record management
• One account per email address
• Community support available

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized access
• Ensuring you meet the minimum age requirement (18 years old)

Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Upload false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users
• Impersonate any person or entity

Data Usage & Consent

By using Rescue Tracker, you consent to:

• Collection and processing of your data as described in our Privacy Policy
• Use of aggregated, anonymized data for product development and marketing
• Publication of statistical and geographic data (anonymized)
• Use of success stories and case studies (with explicit permission only)

Content Ownership

You retain ownership of your Content. However, you grant us a license to:

• Store, process, and display your Content to provide the Service
• Create backups and ensure data redundancy
• Generate aggregate statistics (without identifying information)
• Improve our algorithms and features

Payment & Subscriptions

For Rescue Organizations (Paid Accounts)

• Subscription fees are billed monthly or annually as selected
• Automatic renewal unless cancelled before the renewal date
• Prices may change with 30 days notice
• Refunds are available within 14 days of initial purchase
• Past due accounts may be suspended after 7 days

For Pet Owners (Free Accounts)

• Pet owner accounts are 100% free forever
• No credit card required
• We reserve the right to limit free account features
• We may introduce premium features for pet owners in the future

Service Availability

We strive to provide 99.9% uptime, but we do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Freedom from viruses or harmful components
• That the Service will meet your specific requirements

Scheduled maintenance will be announced in advance when possible.

Limitation of Liability

To the maximum extent permitted by law:

• Rescue Tracker is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount paid in the last 12 months
• For free accounts, liability is limited to $100
• We are not responsible for loss of data due to your actions
• You are responsible for maintaining your own data backups

Indemnification

You agree to indemnify and hold harmless Rescue Tracker from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share
• Your breach of privacy laws or regulations

Termination

You may terminate your account:

• At any time through account settings
• By contacting support
• Subscription cancellation stops future billing

We may terminate your account:

• For violation of these Terms
• For illegal activities
• For non-payment (paid accounts)
• For extended inactivity (after notice)
• At our discretion with 30 days notice

Upon termination: You will have 30 days to export your data before permanent deletion.

Changes to Terms

We may update these Terms at any time. Changes will be:

• Posted on this page with updated effective date
• Communicated via email for material changes
• Effective immediately for new users
• Effective 30 days after notice for existing users

Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of Kentucky, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Louisville, Kentucky.
